If you are a candidate

Where we get your information

We hold candidate information obtained in one or more of the following ways: directly from you, when you apply for a role, send us your CV, register on our website or contact us; from a CV database or job board you registered with, where you agreed that recruiters could contact you about relevant opportunities (we access these under licensed recruiter accounts); from a professional profile you have made publicly available; or from a referral by a colleague, contact or former employer. If you would like to know specifically which of these applies to you, and when, email info@pwrpeople.com and we will tell you.

What we hold

Typically: your name and contact details; your employment history, qualifications and skills; technical certifications and their expiry dates; your right-to-work status; your salary or rate expectations, availability and preferred locations; references; and a record of our communications with you. Where a particular role requires information about your medical fitness to work, or a criminal records check, we will ask for it separately at that point and explain why it is needed. We do not collect it speculatively.

What we use it for, and on what legal basis

We hold your details on our recruitment database and match your skills to vacancies, and contact you about roles we believe are relevant, on the basis of our legitimate interests in operating a recruitment business, and with your consent where that is required for electronic marketing. We send your details to a prospective employer only ever with your specific permission on each occasion. We manage compliance documents and certification expiry to meet client and regulatory requirements (legitimate interests and legal obligation). Where we place you, we administer timesheets, payroll and contracts to perform our contract with you and to meet our legal obligations. We use recruitment software, including automated matching tools, to help us review CVs and identify candidates whose skills match our vacancies. These tools support our consultants; a person always reviews the results and makes every decision about whether to put you forward for a role. Where we rely on legitimate interests, we have considered whether our interest in operating a recruitment business is outweighed by your interests and rights. You can object to this processing at any time.

We will never send your details to an employer without asking you first, sell your personal information to anyone, or use automated decision-making to reject you without a person being involved.

Who we share it with

Prospective employers and clients, only with your specific permission before each submission. Third-party software providers who host our recruitment database and support our operations; they act on our documented instructions under written contract and may not use your information for their own purposes. Payroll, umbrella and background-screening providers, where you are placed and the engagement requires it. HMRC and other authorities, where we are legally required to report.

Transfers outside the UK

Some of our third-party software providers store information outside the UK. Where that happens the transfer is protected either by UK adequacy regulations, or by the International Data Transfer Agreement or Addendum approved by the Information Commissioner.

How long we keep it

We keep your record for 24 months from our last meaningful contact with you. At the end of that period we will either delete it or contact you to ask whether you would like us to keep it. Where we have placed you in work, we keep certain payroll, tax and contractual records for longer, because we are legally required to. If you ask us to stop contacting you, we keep your name and email address on a suppression list so that we do not contact you again by mistake if your details reach us from another source. Nothing else is kept and it is used for no other purpose.

If you are a client or business contact

We hold limited business contact information about people who work for organisations we do business with, or would like to: your name, job title, work email address, work telephone number and employer. We obtain it from your employer's website, from publicly available business sources, from business data providers, or directly from you. We use it to introduce our services, to discuss vacancies and supplier arrangements, and to manage our relationship with your organisation. Our legal basis is legitimate interests: promoting and operating a business-to-business service to the people responsible for hiring at organisations in our sector. You can tell us to stop at any time. Email info@pwrpeople.com, or reply to any message from us, and we will remove you from our contact lists. We will keep the minimum needed to make sure we do not contact you again.

Cookies and our website

Our website uses the cookies necessary for it to function. With your consent, it also uses IONOS SiteAnalytics for basic analytics about how the site is used, and a third-party website translator. We do not use advertising cookies. You can accept or reject these when you first visit, and change your choice at any time using the Privacy Settings link at the bottom of every page. Our online application process is hosted by a third-party recruitment software provider. Information you submit through it is held under the terms set out in this notice.

Your rights

Under UK data protection law you have the right to be told what we hold and what we do with it; to access a copy of the personal information we hold about you; to correct anything that is wrong or incomplete; to have it deleted, in the circumstances the law provides for; to restrict or object to how we use it, including objecting to our legitimate interests; to receive it in a portable format, where it applies; and to withdraw your consent at any time, where we rely on consent. Withdrawing consent is as easy as giving it, and does not affect the lawfulness of anything we did before you withdrew it. To exercise any of these, email info@pwrpeople.com. We will respond within one month. If your request is complex we may need longer, and we will tell you within that first month if so.

Complaints

If you are unhappy with how we have handled your personal information, please tell us first at info@pwrpeople.com so that we have the chance to put it right. You also have the right to complain to the Information Commissioner's Office: Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF. Helpline 0303 123 1113. ico.org.uk
